Develonet's Terms, Conditions, Guarantees & Warranties Agreement

Develonet is a multi-media provider located in Hastings, Michigan which provides website design and programming services as well as graphics and flash development.

Your use of Develonet's services or products is subject to this Agreement and any other terms set forth through the Develonet.com website, and all applicable laws within Michigan and the United States of America. By contracting Develonet's services, you accept, without qualification or limitation the terms and conditions specified in this Agreement. IF YOU DO NOT AGREE TO THIS USER AGREEMENT, YOU SHOULD NOT USE THE SERVICES OR PRODUCTS PROVIDED BY DEVELONET.

Payment Terms
Develonet has a net 15 day payment term after delivery of invoice on ALL work unless otherwise specified by Develonet. A 1/2 down payment is required for all new clients on any project. The balance of ALL projects are due upon the completion of the project or at a time when Develonet has specified its discontinued services on the project at which time a new lower balance will be specified. In the event that a project is not completed for any reasons, the balance specified by Develonet must be paid in full within 15 days of the delivery of the invoice. You agree that Develonet has the right to charge an additional $50/week late fee each week after the past due date.

Disputes, Legal Actions & Court Proceedings
By utilizing any service or product provided by Develonet, you agree that any dispute, legal action, mediation, court proceeding or otherwise that is initiated by either Develonet or by you the client, will ONLY take place within Barry County Michigan Courts or Courts located within Michigan. You agree that you are responsible for representation of yourself or your company and that all fees related to but not limited to any legal actions and other expenses is the full responsibility of you the client.

Copyright Information
Any and all text, graphics, source code, and other content on this web site are proprietary to Develonet. These materials are protected by U.S. copyright and may not be used, copied, transmitted, or reproduced in whole or in part without the express written consent of Develonet. Use of any of Develonet's text, graphics, source code, and editorial content (that is hyper-linked to or affiliated with the web site in any way) for any reason or purpose is strictly prohibited. Unauthorized use of the text, graphics, source code, and editorial content may violate trademark, copyright, civil and criminal statutes, and privacy and publicity laws. Develonet reserves all rights.

If for any reason you are not completely satisfied with Develonet's products or services, we will take any necessary actions, limited to our discretion, to satisfy your complaints, requests or concerns in regards to the initial release of goods or services to you. Develonet offers no guarantee or warranty concerning the condition, performance or implied performance of products or services provide by Develonet or through third party companies, affiliates or partners. Develonet does not make any guarantee as to the performance, or quality of performance of your product or products. We guarantee that all functionality issues concerning your products properly work upon release of the product such as: web site functions, programs written by Develonet, and links. Develonet is not responsible for the performance by third party software even if modified or enhanced by Develonet or a Develonet contractor.
